Can Assault Charges be dropped?
Technically, Texas does not permit the dropping of AFV charges. If police officers respond to the scene, they generally must arrest the alleged perpetrator, who then enters the judicial process. However, alleged victims can choose to file an Affidavit of Non-Prosecution in which they write out their version of the event and request the prosecutor’s office not file charges. The prosecutor will take the affidavit into consideration when determining whether to move forward with the case.
